Racial Diversity in Yoga | Terms & Conditions

Liforme Ltd. (referred to as “us”, “we”, etc. or “Liforme”) is a Limited Company registered in England.  Liforme have set up a programme to support Racial Diversity in Yoga (“the Programme”), which via the Website (as defined below) is accepting donations into the Racial Diversity in Yoga Community Fund (“the Fund”) to support grassroots events and  other activities promoting racial diversity within the global yoga community (“Initiatives”) as well as the ongoing work or activities of certain individuals and/or organisations (“Qualifying Individuals/Organisations”) which directly contribute to the promotion of racial diversity within the global yoga community.  We have also via the Website set up a Racial Diversity in Yoga Community Hub (“the Hub”) for individuals to submit Initiatives and/or Qualifying Individuals/Organisations to be featured on Liforme’s website to be discovered by the community.

We operate the website liforme.com/pages/racial-diversity-in-yoga (the Website). These are the terms and conditions (“Terms and Conditions”) which govern each use you make of the donation payment services or any other information or services provided through the Website and/or any other aspect of the Fund or the campaign to promote awareness and/or fundraising for the Fund or any other related activities conducted by us.

These Terms and Conditions apply separately to each single donation that you make or each submission you make for Initiatives and/or Qualifying Individuals/Organisations to be featured on the Hub. By confirming on the Website that you wish to make a donation or submit Initiatives and/or Qualifying Individuals/Organisations to be featured on the Hub, you agree to be bound by these Terms and Conditions for each such use of the Website and/or otherwise in connection with this community programme.

(1) Donations, Nominations and Allocation of Grants to Nominated Recipients

Donations

We will use your donation in accordance with our stated charitable objectives, as detailed on the Website and/or here in these Terms & Conditions (the latter prevailing in the case of any inconsistency). Donations will consist of those volunteered by our community and submitted on the Website, and those donated by Liforme.

Submissions

Submissions to be featured on the Hub and to be considered to be a potential recipient of grant funding (“Submissions”) will be able to be made by any person, via the Website.  Liforme will also at certain times in Liforme’s discretion offer its customers and community/followers the option to make submissions via Liforme’s own website(s), social media accounts, e-newsletter(s) or via other Liforme channels.

Submissions will only be valid if all the requested information (as detailed in the submissions form) is provided accurately. Submissions must only be made by persons directly responsible for conducting applicable initiatives or bv Qualifying Individuals/Organisations themselves, and must only be made with the authorisation of any other individuals who have any ownership or direct involvement with the applicable initiative.  For example, if you know of a relevant person or initiative which might be suitable to be featured on the Hub or to potentially receive a grant from the Fund, you must contact the person(s) responsible for such initiative and they must directly submit the applicable initiative via the Website.

By submitting Initiatives and/or Qualifying Individuals/Organisations, you warrant that you are fully entitled to provide the applicable information and that you have the authorisation of any other individual or organisation which may be referenced withing the information provided or otherwise in connection with th carrying out of the applicable initiative. 

Submissions including events that have passed will be hosted on the Hub for as long as they are reasonably relevant (in Liforme’s sole and absolute discretion), subject to space and other practical considerations. Liforme reserves the right in its sole and absolute discretion to remove Submissions at any time.

Grants & Selection of Recipients

Liforme will aggregate all submissions received via the Website, and Liforme’s other channels (as referenced above), and allocate the funds to selected recipients (“Recipients”) through grants (“Grants”) as set out below.

1. A) GRANTS FROM PUBLIC FUNDS

Recipients of Grants to be provided out of publicly donated funds (“Grants From Public Funds”) will be picked at random from the list of all Submissions, and all picks will then be subject to further verification checks and eligibility criteria, as set out below in section (2) Verification and Eligibility Checks.

Proposed recipients of Grants From Public Funds will be picked at random using a formula in Microsoft Excel at certain intervals as the Fund increases, from the list of all Submissions received up until such point in time. Submissions not selected in each draw will be re-entered into the next draw, provided it is not an event or other one-off activity where the applicable  date(s) have passed.

All picks will then be subject to a clear and transparent verification check (see (2) below) prior to confirming the allocation and verification of the grant.

The Fund shall be allocated as follows on a quarterly basis (or with different frequency at Liforme’s discretion):

  • $500 Grants to events with less than 50 participants, or other grassroots, local community initiatives or similar, or to qualifying individuals to support smaller scale annual calendar of events and activities or other ongoing relevant activities;
  • $1,000 Grants for events with 50+ participants or larger scale Initiatives or similar, or to qualifying individuals to support larger scale annual calendar of events and activities or other ongoing relevant activities.


2. B) GRANTS FROM FUNDS PROVIDED BY LIFORME

Certain Initiatives and/or Qualifying Individuals/Organisations may be supported by direct allocations of the Fund at Liforme’s discretion (as opposed to random selection), including without limitation certain Initiatives carried out by Liforme’s ambassadors, but on the basis that such initiatives selected by Liforme directly will only be funded by donations made by Liforme itself directly to the Fund.

All payments through the Website are to be made by credit card or a PayPal account. Once you confirm to us through the Website that you wish to proceed with your donation your transaction will be processed through our payment services providers, being Stripe or PayPal or any other providers introduced by Liforme from time to time [“Payment Services Providers”]. By confirming that you wish to proceed with your donation you authorise our payment services providers to request funds from your credit or debit card provider or from your PayPal account (as applicable).

Recipients will be contacted via email from community@liforme.com by the Liforme team and have up to two weeks from first contact to respond. Recipients will be contacted at least twice and if they do not respond after this, Liforme may at any point remove the Recipient from the selection and give the Grant to someone else, pulled at random through the same process described above.

(2) Verification and Eligibility Checks

Upon receipt of Submissions, we will then verify and confirm that each applicable Submission meets the eligibility criteria (“Eligibility Criteria”) to be featured on the Hub and to be entered into the draw to receive an allocation of a Grant from the Fund.  The Eligibility Criteria are as follows:

  • Initiatives must be an event(s) (such as a workshop, local community event, online or offline), training programme or other community-based activity in which a group of at least 15 people participate, and which in each case is clearly focused on advancing cultural and racial diversity within the yoga world. Qualifying Individuals/Organisations must be individual practitioners and/or teachers of Yoga who are engaged in ongoing activities (for example, but not limited to, teacher training programmes and other educational programmes) which are clearly focused on advancing cultural and racial diversity within the yoga world. . 
  • Eligible activities may, by way of example, focus on:
    1. increasing representation 
    2. creating a safe and welcoming environment 
    3. improving accessibility 
    4. providing education and awareness
    5. offering ongoing support and engagement for people of colour or for multi-racial groups. 
  • We must be able to directly contact the nominated recipients in order to verify their identity and request further information if necessary.
  • Initiatives and/or Qualifying Individuals/Organisations must have an active online presence in the form of a website, Instagram page, or similar to demonstrate credibility and validity.
  • For Initiatives and/or Qualifying Individuals/Organisations to be eligible for a Grant from the Fund, they must be able to receive funds via Wise which is the sole payment method through which the Fund shall be distributed (so nominations received for potential recipients based in countries where they cannot receive Wise payments will be ineligible for a Grant from the Fund)
  • Liforme reserves the right in its discretion to determine whether a Submission meets the eligibility criteria to be a qualifying Initiative or a Qualifying Individual/Organisation.
  • Eligibility criteria is subject to change. 

Once confirmed as eligible for receipt of the funds, we will directly contact the selected Recipient to pay them the due amount via Wise (after deduction only of our Payment Services Providers’ transaction charges). 

Liforme otherwise reserves the right to manage the selection of the recipients in its reasonable discretion in line with the stated charitable purpose and mission.

(3) Liforme Contribution to the Fund

Liforme have made (up to 27 September 2023) initial donations to the Fund totalling $15,000, and may make further donations in its discretion over time, including through other promotional campaigns involving its customers and or community.

(4) Unauthorised card use

If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider and seek redress from them. Liforme is not liable for any fraudulent use of the Website.

(5) Information from you

Before we can process a donation you must provide us with (i) your name, address and email address; and (ii) details of the credit or debit card that you wish to use to fund the donation. We will use this information to process your donation. It is your responsibility to ensure you have provided us with the correct information.

When you submit your payment details, these details will be transferred to our Payment Services Providers, and your payment data will be collected and processed securely by them. You should make sure that you are aware of our Payment Services Providers’ terms and conditions, which are different from our own, to ensure that you are comfortable with how they will process your personal data before you make a donation.  We won’t share your personal details with any other third party other than is set out in our Privacy Policy or the Privacy Policy set out through the Donately app used to process donations, which can be found here. Our Privacy Policy forms part of these Donation Payment Terms and Conditions and by agreeing to these Terms and Conditions you are also agreeing to the way we use and protect your personal information in line with our Privacy Policy.

(6) Donation Refund policy

Supporters of the Racial Diversity in Yoga Programme are incredibly important to us. This initiative means nothing without your help, and we believe it will make a huge difference to those advancing this important mission of making yoga more racially equitable.

In order that we may ensure the Fund delivers on its stated charitable objectives and in order to ensure transparency and accuracy of the publication of information about donation amounts to the Fund, donations to the Fund are not returnable or refundable, save in the case of exceptional circumstances (adjudged in our sole and absolute discretion) or where legally required. If you believe that a donation you have made should be refunded, please contact us within 14 days of making your donation at community@liforme.com and our team will get back to you as quickly as reasonably possible to discuss the situation.

(7) Deductions from Payment processing

Donations made to the Fund will attract payment processing fees as charged by our Payment Services Providers.  

Liforme will cover the cost of administering the Website, managing the selection and verification of Recipients of Grants in accordance with the terms hereof and the making payments of Grants, without charge and without deduction of any amounts from those sums donated to the Fund save only for the fees charged by our Payment Services Providers.

(8) General

If you, as a Donor or Recipient, provide photographs or videos to Liforme with respect to the Fund or the campaign relating thereto, you agree that these may be used by us for any purpose in connection with the Fund or the campaign relating thereto or in connection with providing information about Liforme’s charitable and/or community-related work or projects. By sending these to us, you are also warranting that anyone featuring prominently in the photograph has consented to their image being used in this way.

We reserve the right to amend these Terms and Conditions at any time.

These Conditions are governed by English law and are subject to the exclusive jurisdiction of the English courts.
